Welcome to Archetype Massage & Stretch (“we,” “us,” “our,” “Archetype Massage”). These Terms & Conditions (“Terms”) govern your access to and use of our website and services (the “Site”), and the services provided by us (collectively, the “Services”). By using or accessing the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Scope of Services
Massage & Related Services. Archetype Massage provides massage therapy, stretching, facials, and related wellness services as described on the Site.
Appointment Booking & Payments. All bookings are subject to availability. Payment (or deposit) may be required at or before the time of service, via methods we accept.
Modifications. We reserve the right to change, suspend, or discontinue any Service (or portion thereof) at any time without prior notice.
2. Use of the Website & Account
Eligibility. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our Services.
Account. If you create an account or profile with us, you are responsible for maintaining its confidentiality and all activity under it. You agree to notify us immediately of any unauthorized use.
Prohibited Uses. You may not use the Site or Services for any unlawful purpose or in violation of these Terms. You also may not (a) interfere with others’ use, (b) upload harmful code, (c) harvest data, (d) impersonate others, or (e) circumvent security measures.
3. Appointments, Cancellations & Refunds
Booking. You may reserve a time slot via our booking system. Booking confirmation is subject to availability.
Cancellations & Rescheduling. Late cancellations or no-shows may incur a fee (up to the full service price).
Refunds / Credits. Payment or deposit made is non-refundable after the cancellation deadline. Under special circumstances, we may (in our sole discretion) issue a partial credit to be used for future services.
Late Arrivals. If you arrive late, we may shorten your session to avoid affecting subsequent appointments, and you will still be charged for the full session.
4. Health & Safety / Medical Disclosures
Medical Disclosures. Before your session, you must accurately disclose your health history, conditions, injuries, medications, allergies, or any other relevant information that may affect your treatment.
Contraindications. We reserve the right to refuse or modify service if we deem the treatment unsafe for you or in conflict with your medical condition.
No Medical Diagnosis / No Guarantees. Our services are not a substitute for medical care or diagnosis. We make no promises regarding cure, improvement, or results.
Liability Waiver. You agree that Archetype Massage, its employees, agents, and practitioners are not liable for injuries, complications, or damages arising from the session, except where due to gross negligence or willful misconduct.
5. Intellectual Property
Ownership. All content on the Site — text, graphics, logos, images, audio, software, and other materials — is owned or licensed by Archetype Massage.
Limited License. You are granted a limited, non-exclusive, revocable license to access and use the Site for your personal, noncommercial use.
Restrictions. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works without our express written permission.
6. Privacy
Our Privacy Policy (linked here / on the Site) describes how we collect, use, share, and protect your personal information. By using the Site or Services, you also agree to our Privacy Policy.
7. Disclaimers & Limitation of Liability
Disclaimer of Warranties. The Site and Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or noninfringement.
Limitation of Liability. To the fullest extent permitted by law, Archetype Massage’s total liability under these Terms shall not exceed the total amount you paid us for the relevant service. We shall not be liable for indirect, incidental, consequential, punitive, or special damages.
Force Majeure. We are not liable for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, pandemics, government restrictions, technical failures).
8. Indemnification
You agree to defend, indemnify, and hold harmless Archetype Massage, its officers, employees, agents, and contractors from all liabilities, claims, damages, demands, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your use of the Site or Services, or your violation of law or rights of third parties.
9. Termination
We may suspend or terminate your access to the Site or Services, without notice, for any violation of these Terms or other conduct we deem harmful. Upon termination, all rights you were granted will cease.
10. Notices & Communications
We may send notices or communications via email, posting to the Site, or other means. Such notices are deemed given when sent. You may send notices to us via the contact information on our Site.
11. Governing Law & Dispute Resolution
Governing Law. These Terms shall be governed by and construed in accordance with the laws of New Mexico, without regard to conflict-of-law principles.
Dispute Resolution. Any dispute, claim, or controversy arising from or related to these Terms or the Services shall be resolved in Albuquerque, New Mexico.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Waiver. Failure to enforce a right does not constitute waiver of that right.
12. Changes to Terms
We may change or update these Terms from time to time. We will post the revised version on the Site and indicate the “Last Updated” date. Your continued use of the Site or Services after changes constitutes your acceptance of the new Terms.
13. Miscellaneous
Entire Agreement. These Terms (together with our Privacy Policy and any booking terms) constitute the entire agreement between you and Archetype Massage relating to the Site and Services.
Assignment. You may not assign your rights or obligations under these Terms without our written consent. We may assign to a successor entity.
No Third-Party Beneficiaries. These Terms do not confer rights on any third party unless expressly stated.
Headings. Section headings are for convenience and do not affect interpretation.
